Judge: Citizen Has No Right to Question Eligibility of Presidential Candidate

Last Friday, a Federal District judge in Pennsylvania dismissed a lawsuit that questioned Barack Hussein Obama's eligibility to be President of the United States. Philip J. Berg, a Philadelphia lawyer had filed suit against Barack Hussein Obama, challenging Senator Obama’s lack of “qualifications” to serve as President of the United States. In his lawsuit, Mr. Berg alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized she and Obama in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old, to regain his U.S. citizenship status. The lawsuit raises not only the Indonesian citizenship issue but also questions whether Obama was actually born in Kenya and not Hawaii.

The District Court's opinion raises an interesting legal question: Does a citizen have a right to challenge the eligibility of a candidate for President of the United States? Judge R. Barclay Surrick ruled that Mr Berg did not have "standing" (or the right to bring the suit) because he had not suffered an "injury in fact" and that the potential harm caused to Mr. Berg is generalized and abstract. Mr Berg questions the logic of the decision:

If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?.....What happened to ‘...Government of the people, by the people, for the people?"

Berg's lawsuit is not the only one filed, challenging Obama's eligibility. There are apparently as many as 8 lawsuits currently pending. According to one source, Senator Obama's wife does not believe that the courts will disqualify him. She is quoted as follows:

"My husband and I know that there is no law that will stop him from becoming the president, just because some American white racists are bringing up the issue of my husband’s adoption by His step father."

Mr Berg has vowed to appeal the issue to the United States Supreme Court, but with less than a week left before the election, time is running out for a pre-election decision.

In the absence of outright proof that Obama is a "natural born citizen", I can only conclude that we are going to be witness to a coup d'etat from within if he wins the election next week. I'm a naturalized citizen, and just as I have no right to run for the office of POTUS, I did swear to uphold the Constitution..."We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility"...is Obama "insuring domestic Tranquility" by witholding his records? I don't think so.

This whole thing is a con, plain & simple. Berg, a disgruntled Clintonista, is determined to muddy the waters. The case had no merit & he knows it. As a lawyer he would certainly have been expected tpo know what venue to file in, yet he didn't. Why? God only knows, but Occam's Razor tells us that he would presumably know from the get-go that (a) the case would not only be thrown out on jurisdictional grounds, but that it would garner more publicity this way. Surrick threw it out of federal court on grounds that it should have bewen filed in state court.

The 3rd appeals will certainly uphold Surrick's ruling, & the USSC will almost certainly refuse a hearing. Meanwhile Berg gets publicity & his big-lie will keep it in the public eye. Berg knew from the start that legally he didn't have a leg to stand on; he was never relying -- he wanted the case heard in the court of public opinion. He's playing a shell game, & he knows it. Anyone with one eye & half a brain *also* knows it. The gullible, however, may *not*. To quote the late "Texas" Guinan, "Hello, sucker." -snicker-

Whether the question of eligibility is brought forth by a concerned citizen or by an "American white racist" is not the point. As American citizens we all have the right to have our concerns regarding our presidential candidates answered. Shame on you Judge R. Barclay Surrick for failing to defend my neighbors' right to be provided with timely and pertinent information.

Amazing, if you question noboma then you are a racist? So far michelle seems to be the biggest racist yet. Why not clear this all up? Instead the governor of Hawaii seals the records? Seems to me that a revolution is in order if this is allowed to happen. Since honesty is not happening, time for a new government as is our right by the constitution. This thing is really going screwy, posting comments on carriage returns instead of the "post" button. :| In any case, Surrick did his job -- he ruled according to the law. People who are criticizing his ruling would perhaps do better to learn a little more about the law before posting messages that show they're posting with their emotions instead of their brains. I doubt seriously anyone criticizing Surrick has even read his ruling, much less Berg's suit. You've been conned, folks, & are allowing a huckster to sucker you into making damn fools of yourselves in public. *I* for one wouldn't want to show I let a manipulative showboat like Berg gull me into making an idjit of myself in public. };)

This is for Bill. How can you say Surrick did the right thing...all the attorney wanted was Obama to prove that he is a natural born citizen, which indeed is a requirement to be president. All he had to do was show his birth certificate. Not hard at all, if the fact he wasn't hiding something. john mccain showed his birth certificate as soon as he was questioned. it has nothing to do with racisim, all a person wants is his possible future president to prove that he is a natural born citizen. From what you are saying, and that Surrick did the right thing, that means Bin Laden could come in this country and run for president, if indeed Obama is not naturally born. Wake up people.

All he had to do was show his birth certificate" Jason, you were gulled; Berg made a complete sucker out of you. Surrick ruled Berg's case properly should have been filed in DC, not PA. Assuming Berg is not totally mentally incompetent, he knew that before he filed, *&* knew Surrick full well that would rule against him. He knew his "case" would be thrown out before he even took the papers to the courthouse. That's how I can say it, & how I know it. Do *you* know what the law is in this case? It would seem not. ;) Berg used you & all the rest to yell for him. Feeling foolish yet? ;)

For all you Obama supporters out there, ask yourself. Why is Obama sending out all his high priced lawyers to fight having his birth certificate released? My son has to show his birth certificate just to play little league baseball for crying-out-loud! Wouldn't it just be easier to produce it, along with all of his missing college records, then to have half the nation wonder if he's even eligible. Me thinks he has something to hide.

Another day, another suit tossed. Cracked me up, although I'm sure it will make a rather minuscule number of people mad as fire. }:) More ... I particularly liked the judge's comments that Neal's suit was based on his reading too much on the web, & the fact that the burden of proof is on the *challenger*, not the challengee. }}:) "“It is abundantly clear that the allegations in Plaintiff’s complaint concerning ‘questions’ about Senator Obama’s status as a ‘natural born citizen’ are derived from Internet sources, the accuracy of which has not been demonstrated." I suppose hoi polloi will REALLY get them widdle knickers in a knot over this one....

All dialog aside: Just a simple question.

Do we have a right, as citizens, to know if a candidate qualifies under the laws of our land to run for public office?

Who do we ask? Who is the enforcer of these laws?
Are the answers not being given because of some racial fear? Who do we get legal answers from without all the political dialog?
