Obama Citizenship Lawsuit To Be Amended To Add Defendants

Philadelphia attorney Philip J. Berg has sought court approval to amend his complaint in a lawsuit styled Berg v. Obama. The amended complaint would add the Pennsylvania Department of State, the Secretary of the Commonwealth Pedro A. Cortes (in his official capacity), the U. S. Senate Committee on Rules and Administration, and Senator Diane Feinstein (in her official capacity as chairman) for their failure to exercise due diligence with respect to Barack Hussein Obama's constitutional qualifications to be elected and serve as President of The United States, and for his inclusion on the ballot in Pennsylvania as a candidate for President of the United States.

In his original complaint, Mr. Berg alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old to regain his U.S. citizenship status.

According to a web site maintained by the Plaintiff, the amended complaint is intended to clarify issues regarding the plaintiff's standing to bring the lawsuit and supplement the lawsuit with additional relevant facts. Those additional facts are summarized at that web site.

According to the Washington Times, the Obama campaign has firmly said the Illinois Democrat is a natural-born citizen. Last month, the campaign posted on Obama's Web site a copy of his certification of live birth. It says he was born in Honolulu on Aug. 4, 1961. The Obama web site, commenting on questions regarding whether Obama is a citizen of Kenya, cites FactCheck.org as follows:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

The issue of Obama's citizenship have been the topic of internet sites for months. Documents and photographs, claiming that Obama was registered in schools in Kenya under the name of Barry Soetoro, have been circulated through a variety of blogs and web sites which has fueled the debate. The Berg lawsuit raises not only the Kenyan citizenship issue but also questions whether Obama was a citizen of Indonesia. According to the allegations of the Plaintiff, Obama lost his U.S. citizenship when his mother married an Indonesian citizen, Lolo Soetoro, who legally “acknowledged” Obama as his son in Indonesia and/or “adopted” Obama, which caused Obama to become a “natural” Indonesian citizen.

The parties are waiting on the court to rule on a motion to dismiss filed by Barack Hussein Obama. Lawyers for Obama and the Democratic National Commitee have also filed a motion for a protective order staying discovery in the case until the court rules on the motion to dismiss.

Obama Citizenship Lawsuit Headed to U.S. Supreme Court?

Philip J. Berg, the lawyer who filed suit against Barack Hussein Obama, challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court.

Yesterday, Judge R. Barclay Surrick dismissed the suit brought by Berg, ruling that Berg did not have standing to bring the suit. In his lawsuit, the Plaintiff, Berg, a Philadelphia attorney, alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old, to regain his U.S. citizenship status. The lawsuit raises not only the Indonesian citizenship issue but also questions whether Obama was a citizen of Kenya.

Mr. Berg has stated that if Barack Hussein Obama will produce a certified "vault" birth certificate, a copy of his Certificate of Citizenship and a copy of his Oath of Allegiance to the United States, that he (Mr. Berg) will dismiss his lawsuit voluntarily. To date, Obama has refused to comply with Mr. Berg's request.

Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court. This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?.....What happened to ‘...Government of the people, by the people, for the people?"

Berg's lawsuit is not the only one filed, challenging Obama's eligibility. There are apparently as many as 8 lawsuits currently pending.

In Honolulu, Andy Martin, a longstanding critic of Mr. Obama, filed a lawsuit, asking the Hawaiian Department of Health to release Mr. Obama's birth certificate records.

In the state of Washington, Steven Marquis, a resident of Fall City, Wash., a town about 30 miles southeast of Seattle, has filed a lawsuit against Washington Secretary of State Sam Reed, demanding that Mr. Reed verify Mr. Obama's citizenship status. The complaint seeks specifically that the office of the Washington Secretary of State verify and certify that Mr. Obama is or is not a "natural born" citizen by producing original or certified verifiable official documents. The lawsuit argues that this certification should take place before the election to preclude a constitutional crisis.

The interesting question to be possibly answered by the U.S. Supreme Court is whether voters, whether Republican, Democratic or Independent, have a right, under the Constitution, to challenge the eligibility of a presidential candidate. Hopefully, if that question is to be addressed by the Supreme Court, it will be decided before the election on November 4.

Judge: Citizen Has No Right to Question Eligibility of Presidential Candidate

Last Friday, a Federal District judge in Pennsylvania dismissed a lawsuit that questioned Barack Hussein Obama's eligibility to be President of the United States. Philip J. Berg, a Philadelphia lawyer had filed suit against Barack Hussein Obama, challenging Senator Obama’s lack of “qualifications” to serve as President of the United States. In his lawsuit, Mr. Berg alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized she and Obama in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old, to regain his U.S. citizenship status. The lawsuit raises not only the Indonesian citizenship issue but also questions whether Obama was actually born in Kenya and not Hawaii.

The District Court's opinion raises an interesting legal question: Does a citizen have a right to challenge the eligibility of a candidate for President of the United States? Judge R. Barclay Surrick ruled that Mr Berg did not have "standing" (or the right to bring the suit) because he had not suffered an "injury in fact" and that the potential harm caused to Mr. Berg is generalized and abstract. Mr Berg questions the logic of the decision:

If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?.....What happened to ‘...Government of the people, by the people, for the people?"

Berg's lawsuit is not the only one filed, challenging Obama's eligibility. There are apparently as many as 8 lawsuits currently pending. According to one source, Senator Obama's wife does not believe that the courts will disqualify him. She is quoted as follows:

"My husband and I know that there is no law that will stop him from becoming the president, just because some American white racists are bringing up the issue of my husband’s adoption by His step father."

Mr Berg has vowed to appeal the issue to the United States Supreme Court, but with less than a week left before the election, time is running out for a pre-election decision.

Barack Obama Seeks To Block Discovery in Citizenship Lawsuit

In a lawsuit styled Berg v. Obama, lawyers for Barack Hussein Obama have filed a Motion for Protective Order, seeking to block discovery until his motion to dismiss is ruled on by the court. The Motion for Protective Order filed by Obama and the Democratic National Committee, asks the court to issue a protective order stopping "all discovery in this action pending the Court's decision on defendant's motion to dismiss the action for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted."

In his lawsuit, the Plaintiff, Philip J. Berg, a Philadelphia attorney, alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old, to regain his U.S. citizenship status. The lawsuit raises not only the Indonesian citizenship issue but also questions whether Obama was a citizen of Kenya.

The motion to block production of documents is just the latest in a series of filings in the case, but has become a focal point of the suit. According to a web site maintained by the Plaintiff, the Plaintiff requested that three documents be produced by Obama:

1. a certified copy of Obama’s “vault” (original long version) Birth Certificate;

2. a certified copy of Obama’s Certificate of Citizenship; and

3. a certified copy of the Oath of Allegiance taken by Obama at the age of majority.

Mr. Berg asserts that if Barack Hussein Obama will produce the above documents and prove his eligibility for the Office of the Presidency, that he (Mr. Berg) will dismiss his lawsuit voluntarily. To date, Obama has refused to produce these documents to Mr. Berg.

Obama Files Motion in Citizenship Lawsuit

Attorneys for Barack Hussein Obama filed a motion in Federal Court in Pennsylvania on Monday, asking the court to dismiss the Amended Complaint filed by Philip J. Berg. The lawsuit filed by Berg challenges Obama's eligibility to take the office of the President of the United States. The motion to dismiss filed by Obama and the Democratic National Committee, echoes Obama's prior motion to dismiss the action for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted.

Mr. Berg has stated that if Barack Hussein Obama will produce a certified "vault" birth certificate, a copy of his Certificate of Citiizenship and a copy of his Oath of Allegiance to the United States, that he (Mr. Berg) will dismiss his lawsuit voluntarily. To date, Obama has refused to comply with Mr. Berg's request.

The parties (and the country) await a decision by Judge R. Barclay Surrick on the motions to dismiss and a motion to block discovery, filed by Obama.

U.S. Supreme Court Asked to Delay Presidential Election

According to a press release from attorney Philip J. Berg, he filed a request with the United States Supreme Court on Thursday afternoon, for an injunction staying the presidential election until the Supreme Court determines whether Barack Hussein Obama is eligible to be President of the United States.

According to Mr Berg, he has filed two documents:

Application for an Immediate Injunction to Stay the Presidential Election of November 4, 2008; and
Petition for Writ of Certiorari.

Berg stated, “I am hopeful that the U.S. Supreme Court will grant the Injunction pending a review of this case to avoid a Constitutional Crisis by insisting that Obama produce certified documentation that he is or is not a “natural born” citizen and if he cannot produce documentation, that Obama be removed from the ballot for President".

Berg’s original lawsuit, Berg vs. Obama, was dismissed by the United States District Court for the Eastern District of Pennsylvania last Friday, for lack of standing. Berg questions the logic of the District Court's decision:

"This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?"

With the presidential election a mere five days away, the Supreme Court will need to act quickly. It is unknown whether Berg asked for an emergency hearing.

Dog Bite Prevention

The recent National Dog Bite Prevention Week created awareness of how big the problem of dog bites is in the United States, as well as provided education on how to prevent dog bites. According to the Centers for Disease Control and Prevention (CDC), about 4.5 million Americans are the victims of dog bites annually. Of these victims, about one in five require medical attention due to their injuries (totaling 885,000). Over 31,000 people underwent reconstructive surgery as a result of being bitten by dogs in 2006. People most at risk for being bitten by a dog include children, adult males, and people with dogs in their homes.

There are ways to make dog bites less likely for adults and children. If a household is considering bringing a dog into their home they should first consult with a professional to find out what breed best fits the household, never choose a dog that has a history of aggressive behavior if there are children in the home, pay attention to fearful cues children are showing when around dogs (if any), spend time with the dog before adopting it, and use caution when bringing a dog into a home with infants or toddlers.

Once a dog is brought into a home, spay or neuter the dog, never leave the dog alone with infants or toddlers, avoid playing aggressive games with the dog, properly socialize and train the dog, and contact a professional if the dog develops aggressive behavior.

To help prevent a child from being bitten, teach and follow the safety tips outlined by the CDC:

Do not approach an unfamiliar dog.

Do not run from a dog or scream.

Remain motionless (e.g., "be still like a tree") when approached by an unfamiliar dog.

If knocked over by a dog, roll into a ball and lie still (e.g., "be still like a log").

Do not play with a dog unless supervised by an adult.

Immediately report stray dogs or dogs displaying unusual behavior to an adult.

Avoid direct eye contact with a dog.

Do not disturb a dog that is sleeping, eating, or caring for puppies.

Do not pet a dog without allowing it to see and sniff you first.

If bitten, immediately report the bite to an adult.

U.S. Supreme Court Justices to Meet to Discuss Obama Eligibility

According to the docket sheet of the United States Supreme Court, all 9 justices of the Court are scheduled to have a full conference on Friday, December 5, 2008, to discuss one of the two cases currently pending in the Supreme Court that question Barack Hussein Obama's eligibility to serve as the President of the United States.

The case, Leo C. Donofrio v. Nina Mitchell Wells, Secretary of State of the State of New Jersey, US Supreme Court Docket No. 08A407 raises the issue of whether Obama is eligible, as a natural born Citizen, as is required by Article 2, Section 1, Clause 5 of the Constitution of the United States.

If four of the nine Justices vote to hear the case in full review, oral argument may be ordered. The December 5th conference comes just ten days before the meeting of the Electoral College.

Tallahassee Man Loses Control Of His Car, Hits Telephone Pole

A man lost control of his vehicle on Wednesday morning and struck a telephone pole and then slammed into a gas station sign. He was taken to Tallahassee Memorial Hospital.

When emergency officials arrived at the scene he was unresponsive. No other injuries have been reported. Police have not released new details on the condition or the identity of the man involved in the car accident.

The accident occurred on Tharpe Street and Old Bainbridge Road.

The investigation is ongoing.

Later the same day, Tallahassee Police were investigating another car crash at the intersection of Bronough and Gaines Street. Four vehicles were involved in the crash, but none suffered serious injuries.

What to Do If You've Eaten Contaminated Peanut Butter Product

The number of products that contain peanuts or peanut paste manufactured by the Peanut Corporation of America continues to grow. The list has topped 1,000 affected products and includes many popular cookies, candies and snack bars.

If you have eaten any of these products and have suffered symptoms consistent with salmonella exposure, it is suggested that you go to the Emergency Room or walk in clinic today and tell them what you have eaten and what your symptoms have been. Ask them to test you for salmonella exposure (usually a stool test). If some time has passed between your consumption of the crackers and the salmonella test, there's a chance that it will come back normal, but a test is the best way to determine if you have been exposed to salmonella.

Also, it is important to keep the product that you have eaten (or at least the package). They may need to be tested at a lab. Put them in a sealed container or plastic baggie and keep them in a cool dry place.
